The short answer is kind of. Private school are just that private, so they are not bound to public education laws such as IDEA. However the school district that the child would go to is obligated to ,provide all aspects of IDEA. This includes but is not limited to evaluations, therapies, supports and services at the Childs choice of school. Charter an magnet schools are 9 time out of 10 PUBLIC . This means that although " boutique" in approach, they are still obligated to follow the law if they receive IDEA Federal funds.

Lets start with how they are similar. Both are FEDERAL law which means every public school in the country MUST follow them if the district receives those federal funds. IDEA funds are NOT local, they are Federal. Section 504 consists of  Accommodations ONLY without the need of any specially designed instruction or SDI, or related services such as OT, PT, Speech and ABA. An IEP will include but is not limited to goals, services, and is much more complex. FAPE includes Academic and Functional  performance that include but are not limited to social emotional , adaptive, and executive functioning skills,
